Spousal Sponsorship: Bringing Loved Ones to Canada

Spousal sponsorship in Canada allows citizens and permanent residents to sponsor their spouse, common-law partner, or conjugal partner for permanent residency. To qualify, you must be at least 18 years old and your relationship must fall into one of the following categories, including recognizing same-gender partnerships: Spouse, Common-law Partner and Conjugal relationships.

Eligibility Criteria to become a Sponsor

  • You need to be a minimum of 18 years old
  • You must be a Canadian citizen, a registered Indian under the Canadian Indian Act, or a permanent resident residing in Canada. If you are a Canadian citizen living abroad, you must demonstrate your intention to live in Canada when your sponsored relative becomes a permanent resident. Permanent residents living outside Canada are not eligible to sponsor someone
  • You should be able to provide evidence that you are not receiving social assistance for reasons other than a disability
  • Additionally, you must demonstrate your capability to provide for the basic needs of yourself, your spouse or partner, your spouse or partner's dependent child(ren) if applicable, and your dependent child(ren) if you are sponsoring only your dependent child

Relationship must be:

  • Spouse: You and your partner are legally married
  • Common-law partner: You have lived together in a marriage-like relationship for at least 12 months.
  • Conjugal relationships: These involve being in a relationship for at least a year but unable to live together due to various circumstances.

  • Who can not Sponsor?

  • - If you signed an undertaking for a previous spouse or partner, and it's been less than three years since they became a permanent resident.
  • - If you sponsored someone before and didn't repay social assistance received during the sponsorship.
  • - If you're in default on an immigration loan or performance bond.
  • - If you haven't paid court-ordered alimony or child support.
  • - If you've declared bankruptcy that hasn't been discharged.
  • - If you've been convicted of a sexual, violent, or offense against a relative causing harm, or attempted such offenses, depending on the nature and timing, even with a pardon.
  • - If you were sponsored as a spouse, common-law, or conjugal partner and became a permanent resident of Canada less than five years ago.
  • - If you're under a removal order, incarcerated, or currently awaiting a decision on sponsoring your current spouse or partner.
